What Penalties Can I Expect?

Convictions for marijuana cultivation can result in a misdemeanor or felony offense, but it all depends on how much marijuana or cannabis plants are found in the grow house at the time of the arrest. The severity of the penalties depend on the amount of the marijuana found, and two ounces or less can be a misdemeanor punishable by a jail sentence of up to 180 days and/or a fine up to $2,000.

If the amount of marijuana found is over four ounces and under five pounds, it is classified as a third degree felony and is punishable by a prison sentence of 2 – 10 years, and/or a fine up to $10,000. The fines and amount of jail time increase with the amount of marijuana found.
