Robbery vs. Aggravated Robbery

Generally, robbery is classified as a second degree felony, and the penalties can include prison sentences of up to a 20 years and fines up to $10,000.

  2. Intentionally or knowingly threatened or placed another in fear of bodily injury or death

The penalties for aggravated robbery are even more serious than the penalties for robbery. Since aggravated robbery is classified as a first degree felony, the penalties may include up to 99 years of imprison and a $10,000 fine.

The offense of robbery can be enhanced to aggravated robbery if it is alleged that the defendant committed any of the following acts during the commission of the crime:

  1. Caused serious bodily injury to another
  2. Used or exhibited a deadly weapon
  3. Threatened or placed another person in fear of injury or death when that person was 65 years or older or disabled
